Kniha jízd chytře Terms of Use and Subscription Terms
Effective from: {EFFECTIVE_DATE}
1. Provider
The Kniha jízd chytře application and service (the “Service”) are provided by:
Ing. Jaroslav Beneš
Company ID: 05896860
VAT ID: CZ7704105684
Halštatská 1691/16, Prague 10, Czech Republic
email: podpora@kniha-jizd-chytre.cz
(the “Provider”). These Terms govern the mobile and web application, the Free version and Premium subscriptions. Personal data processing is described separately in the Privacy Policy.
2. Acceptance and age
By using the Service, you agree to these Terms. When creating an account, you agree to the Terms and acknowledge the Privacy Policy.
Only persons aged 15 or older may create an account. The initial Service is for individual users and does not provide team accounts, employer administration or company sharing.
3. Purpose
The Service helps users record vehicles, trips and related information. It includes manual trip entry, vehicle records and exports. Premium features may include EU cloud synchronization, the web application, manually started GPS recording, optional route display in Google Maps, one-time road matching, address or distance suggestions and extended exports.
The Service is a record-keeping aid, not accounting, tax or legal advice. It does not guarantee that a record satisfies every requirement of a tax authority, employer or other body. The user is responsible for the accuracy, completeness and timeliness of final records.
4. Free version
The Free version may be used without an account. It provides unlimited manual trip recording, basic exports and local-only device storage. Cloud synchronization is excluded.
The Provider cannot recover local-only data. Users should export it regularly. Where supported, sensitive application data is intentionally excluded from standard OS cloud backups.
5. Account and security
Premium and cloud functions require an account with a verified email address. Users must provide accurate information, protect credentials and promptly report suspected misuse.
Users may sign out on the device they are currently using or sign out of their account on all devices. For technical reasons, signing out may take a short time until access automatically expires. If the Provider has reasonable grounds to suspect that an account is being misused or that its security is at risk, the Provider may sign the user out or temporarily restrict the account.
6. Premium subscriptions
At launch, Premium is sold only through Apple App Store or Google Play. The monthly price is {MONTHLY_PRICE} and the annual price is {ANNUAL_PRICE}; the annual price equals ten times the monthly price. The price, currency, tax and terms shown by the relevant store before purchase prevail. No free trial is offered at launch.
Premium is linked to the verified account, not a device, and may be used on supported iOS, Android and web clients under that account. Accounts must not be shared.
The applicable store handles payment, automatic renewal, billing, refunds and subscription management. A subscription renews automatically until cancelled in the Apple or Google subscription settings. Uninstalling the app or deleting the account may not cancel the store subscription.
We do not store card details. We store only the platform, transaction/subscription identifier, plan, status, relevant dates and last-verification time needed to verify entitlement.
7. Premium expiry
When Premium ends, the account returns to Free mode. Existing cloud data remains read-only and exportable for 90 days; new cloud data cannot be created. We send service reminders approximately 30 and 7 days before deletion where a working email is available.
After 90 days, cloud data may be deleted from active systems and overwritten in backups within a further 90 days. The account remains active until the user deletes it.
8. GPS and location
GPS recording is manually started and stopped. Location permissions are requested in context. Users may change permissions at any time, which may disable functions.
Mobile OS restrictions, power saving, signal loss, device shutdown or user actions may interrupt recording. Continuous recording cannot be guaranteed in every circumstance. Users must review route and distance after each trip.
During a trip, the application records the GPS location at short intervals. The record is stored on the user’s device and, in the Premium version, synchronized with a server located in the EU. The GPS route is retained until the user deletes the relevant trip or the entire account and serves as the original historical record of the trip.
The distance travelled is calculated either on the user’s device or on a server located in the EU. The user may subsequently adjust it. Google Roads may help provide an approximate visual representation of the route, but it does not determine the authoritative route or final distance.
9. Google Maps, address suggestions and temporary road matching
Premium users may display a recorded GPS route on a Google map after giving separate consent. Consent must be given in advance and may be withdrawn at any time. When the map is loaded, the user’s device or web browser connects directly to Google. Google may therefore receive information such as the user’s IP address, technical information about the device or browser, the displayed map area and information about the user’s interactions with the map.
Google features are not required for manually maintaining the logbook, recording GPS routes, synchronizing the original GPS points or exporting data.
Google Roads is used only when the user selects “Process and display route” for a specific trip. Our server sends Google only the GPS points required to process that route. The user’s email address, account ID and device ID are not included. The request is sent from our server, so Google does not receive the IP address of the user’s device as part of the Google Roads request. However, the GPS coordinates themselves may indirectly reveal the user’s movements and places visited.
The result is used only to display the route temporarily on a Google map. It may be retained for no longer than 30 days and is not permanently stored as the historical record of the trip.
A route created by Google Roads is for guidance only. It is based on Google’s current map data and processing methods. Processing the same trip again at a later date may therefore produce a different result. The original GPS points stored in the EU remain the historical record. The user must check the final distance and other trip details.
We may change, restrict or discontinue the availability of Google features, particularly for licensing, technical or security reasons.
The Service includes Google Maps features and content. Use of these features is subject to the then-current Google Maps/Google Earth Additional Terms of Service and Google Privacy Policy.
10. Exports
The Service may provide PDF, CSV and GPX exports. Registered users may request a complete JSON or ZIP personal-data export. Exports can contain sensitive movement data; users are responsible for secure storage and disclosure.
A complete export requires authentication and may require recent reauthentication. The protected download link is valid for no more than 24 hours; the archive is not sent as an email attachment.
11. Deletion
Deleting a trip also deletes associated GPS points from active systems. Backup copies expire through the documented overwrite cycle.
An account may be deleted in the mobile or web app or through a verified request to podpora@kniha-jizd-chytre.cz. Instructions are at https://kniha-jizd-chytre.cz/en/account-deletion.
Users with an active subscription are reminded to manage it separately through Apple or Google. They may schedule deletion at the paid-period end or choose immediate deletion after explicit confirmation. Active data is deleted within 30 days and backup copies within a further 90 days. Limited records may be retained where required by law or legal claims.
12. Availability, updates and liability
We may issue functional and security updates. Users must use a supported app and OS version. Temporary unavailability may occur because of maintenance, failures, platform actions or events outside our control.
The Provider is liable for non-conformity and damage to the extent required by mandatory law. Nothing in these Terms limits non-waivable consumer rights. In particular, the Provider is not responsible for incorrect user-entered or user-confirmed data, loss of local-only data without available synchronization, or decisions made from an unverified export.
Report defects or complaints to podpora@kniha-jizd-chytre.cz. Include the account, device, app version and issue description, but do not email full GPS trails or unnecessary sensitive trip data.
13. Prohibited use
Users must not misuse the Service, bypass security or subscriptions, access another person's data, disrupt operation, distribute malicious code or use the Service unlawfully. Serious or repeated violations may lead to proportionate restriction or termination. Where safe and practicable, advance notice and a data-export opportunity will be provided.
14. Intellectual property
The software, design, text, branding and other Service content are protected. For the contract term, users receive a limited, non-exclusive and non-transferable right to use the Service for their own purposes. Users retain rights in their data and grant the Provider only the rights necessary to operate the Service.
15. Changes
We may reasonably amend the Terms because of law, security, technology, functionality, costs or the business model. Registered users will receive an email at least 30 days before a material change, containing a summary, the new text, effective date and the right to terminate before that date. Continued use after effectiveness constitutes acceptance where permitted by law.
Legally required or urgent security changes may take effect sooner with an explanation. Subscription price changes follow Apple or Google rules.
16. Termination
Users may stop using the Service and delete their account at any time. Store subscriptions must be cancelled in the relevant store. The Provider may discontinue the Service with reasonable advance notice and an export opportunity, unless immediate action is required by law or security.
17. Law and consumer disputes
Czech law applies without depriving consumers of mandatory protection. Contact us first at podpora@kniha-jizd-chytre.cz. Consumers may use out-of-court dispute resolution by the Czech Trade Inspection Authority, Štěpánská 796/44, 110 00 Prague 1, https://coi.gov.cz/informace-o-adr/, without prejudice to court remedies.
18. Language
The Terms are available in Czech and English. The Czech version prevails in case of conflict.
